Cerebral Palsy Claims
Tragically, a number of babies sustain brain damage at birth each year resulting in cerebral palsy as a result of negligent care at the time of their birth. Attwaters has successfully pursued many cerebral palsy cases, recovering millions of pounds in damages for such children. Whilst such awards appear large, compared with others, the damages reflect the fact that these children often need very substantial care throughout their lives.
These claims are often very complex and need to be dealt with by very experienced Lawyers in the field. Attwaters has that experience. Investigations into such claims involve obtaining all the relevant medical records and thereafter reports from numerous experts relating to whether the care provided was negligent and, if so, whether this was responsible for the child’s cerebral palsy. Often brain scans need to be obtained to assist in establishing liability.
In addition, the value of such claims needs to be looked at very carefully and it is common for reports to be obtained from experts relating specifically to this, for instance such children may have complex housing needs, care needs, and will need physiotherapy and speech therapy for many years. They are also likely to need specialist equipment. We are able to obtain the full range of reports that are often needed to ensure that such clients are properly compensated.
There are degrees of cerebral palsy but even where, on the face of it, the cerebral palsy is not the most severe, Attwaters has succeeded in recovering very substantial damages. In 2 recent cases where the children concerned were able to attend regular State Schools, we recovered, in one case, damages of £2.4 million and in the other £4.1 million.
We pride ourselves in dealing with such cases in a sympathetic and efficient manner. We are very aware of the pressures on families whose children have suffered cerebral palsy and, for instance, will look at obtaining early initial payments, if possible, before a case can be finally concluded, to ensure that such children receive all the care and support they need.
As specialist Medical Negligence Lawyers we are able to support families and will ensure that they receive as much help as is available. We can arrange a Case Manager to be appointed to ensure that such children get all the support they need and reducing the burden on their families where we are able to establish liability. We will also give advice as to the best time, taking into account the child’s age, before finally resolving such cases to ensure that such children receive proper compensation.
As we have a legal aid franchise to pursue clinical negligence claims, we can obtain legal aid to pursue cerebral palsy claims.
We have a high success rate in pursuing medical negligence claims, including cerebral palsy claims and pride ourselves on our commitment to our clients and achieving justice for them.
