Birth Injury

Sadly, pregnancy and labour are medical conditions that are fraught with risks to both mother and baby.  It is therefore imperative that midwifery and medical care is of a high standard to ensure the delivery of a healthy baby.

Tragically the lack of adequate hospital care can lead to devastating consequences.  Conditions that may cause complications in pregnancy and labour include preeclampsia and diabetes.  If properly monitored and treated these, among other, high risk conditions can be managed successfully.  However, sadly we have dealt with cases where babies have died or been injured due to a variety of medical errors including:-

•    Staff failing to expedite delivery of the baby by emergency caesarean section
•    Failure of midwives and/or clinicians to properly monitor and interpret heart rate traces relating to the baby’s       condition leading up to birth
•    Failing to follow up and act upon test results indicating conditions such as gestational diabetes
•    Failing to provide adequate diabetic care during pregnancy
•    Failing to manage an induction of labour adequately
•    Failing to arrange prompt transfer to hospital when complications arise in home births and/or birthing units

These cases are tragic and very emotional for the families involved.  We have helped families secure justice in the form of apologies, damages and recognition of wrong-doing.  Damages have helped to secure the future care needs of the injured child and psychiatric treatment and counselling for the parents devastated by the loss of a child.
