Is there a time limit for bringing a claim?
In medical negligence cases court proceedings must be commenced within 3 years of the date of the injury or the date when a Claimant could reasonably have been expected to know that the injury was significant and attributable to the alleged negligent treatment or care If court proceedings are not started within this period, you may be unable to pursue a claim.
The exceptions to this general rule are minors, in whose case the three year period does not commence until their 18th birthday, and for the mentally incapacitated, for whom there may be no time limits, depending on their level of incapacity.

How long will my claim take?
It is impossible to provide exact details of how long a claim may take to conclude, as much depends on the facts, but an average timescale for many medical negligence claims is between 12 to 18 months, provided settlement can be negotiated between the parties. If court proceedings are required, it can take a further 12 to 18 months.
