Settlement Discussions
At all times, it is important to continue to explore the possibility of a negotiated settlement. It saves time, legal costs and the potential stress of giving evidence at Court. The vast majority of cases are resolved by way of a negotiated settlement between the parties.
Settlement can be achieved at any time after the claim has been properly investigated and quantified. The case can be settled before or after Court Proceedings have been commenced. Sometimes a mediator is appointed to help achieve settlement. Often written offers to settle for a specific amount are made by both sides.
The Defendant may make offers on any part of the case, for example admit the treatment received was negligent but that this did not cause your injury, and may still dispute the amount of compensation being claimed.
Any negotiations leading to settlement of your claim will need to take account of all aspects of the case and the possible levels of compensation in all the different heads of claim being pursued.
