Letter of Claim and Response of Defendant
If a supportive medical report has been obtained we will prepare and send a detailed Letter of Claim to the appropriate Defendant(s). Sometimes we enlist the help of a Specialist Barrister to advise and help with this step. All Defendants or solicitors instructed upon their behalf have at least three months to investigate the allegations and send a Letter of Response.
If it is admitted that the care received was negligent, and caused injury to you, we will conduct any further investigations needed into your injuries and the losses arising from the negligent treatment. If the Defendant is not willing to settle the claim for what we consider to be an acceptable amount, legal proceedings will be issued through the Court. Where possible we will also seek an interim payment of damages in advance of a final settlement to ease your financial pressures.
If it is denied that the treatment you received was negligent and/or caused you injury, further enquiries may need to be made with medical experts and we will conduct any investigations arising from the Letter of Response. Following these further investigations, if there remain sufficient prospects of success, a report may have to be commissioned from a medical expert into your current symptoms and future prognosis, following which legal proceedings will probably be commenced.
