Probate

Probate, or the Administration of Estates, is the process of sorting out a person’s legal and financial affairs after they have died. Being given the task of winding up someone’s estate has heavy responsibilities and can be legally difficult. This is quite apart from the fact that after the loss of someone close to you, dealing with these matters may prove personally distressing. With this in mind, we will relieve you of the burden of getting probate. Thereafter we can ensure that the deceased’s estate is wound up correctly and efficiently and that their wishes are followed.

How an estate is dealt with depends on whether or not the deceased left a valid Will. If a Will is in place and you have been named as the executor, we can help you apply for a Grant of Probate. This is an official document needed by law before the assets of the deceased can be distributed.

Where there is no valid Will (known as dying intestate) the process is more complicated. The law dictates who has the legal right to administer the estate. This person (or persons) will need to apply for a Grant of Letters of Administration, the official document required to deal with the estate. We can assist you with this application.
