Personal Injury Trusts

Attwaters has extensive experience of personal injury trusts. This is not in fact a specific type of trust but is a description of the source of the money used to set up the trust. Personal injury trusts are usually (though not exclusively) created in circumstances where the person who has been injured is already in receipt of means-tested benefits and wishes to preserve their and their family’s entitlement to means-tested benefits, even though they are due to receive a payment of damages arising from a personal injury claim.

There are other possible reasons for creating a personal injury trust. For example, the injured person may have no experience of handling large sums of money, or they may wish to protect their damages from grasping relatives or friends. Alternatively the injured person may have an unstable mental condition, or may just want to get on with life without worrying about financial administration.

A crucial point to note is that if you wish to create a personal injury trust in order to preserve entitlement to means-tested benefits, the trust must be created before you have received the money.

Attwaters can advise you about the appropriate type of trust for you, in conjunction with your personal injury lawyer.
